County of Yancey
On the 6th day of August in the year 1855 personally
appeared before me the undersigned, James C. Howell, one
of the acting Justices of the Peace in and for both County
and State, james McMahon aged eighty years, a resident
of Yancey County who being duly sworn according to law,
says on his oath that he has no interest of any kind in the
matter of which he is going to testify, and is not related to
any of the parties. That he was borned in the State of Vir-
ginia and before he left that State he was for several years
peresonally and well acquainted with the Jones family and
especially with William Jones who was also borned and
raised in said State of Virginia. That declarants father
Richmond (perhaps Redmond) McMahon was a soldier of
the Revolutionary War in the Virginia Continental Line. That
William Jones and he were very intimate friends and a great
deal together, and when in each other's company their con-
versation was frequently about the War of the Revolution and
that both spoke of Jone's service in said War as being an
enlistment for same Line and three years. The precise time
he can not recollect. The declarant's father often spoke of
William Jones as a true and faithful soldier, and said he ____
_____ true grit as ever shouldered a musket and the _______
said that Jones and Richmond (perhaps Redmond) McMahon
frequently talked for hours about the service of each other, the
battles and hardships through which they passed, and the
length of time they served and from these repeated conver-
sations his present recollection is that the said William Jones
enlisted and served for 3 years which fact he learned from both
parties, his father's enlistment being for about the same time.
Declarant further states that the Jones family were all men of
good character and one of his brothers, Major Jones, repre-
sented Grayson County Virginia in the legislature for several
years. That William Jones was a man of great standing in that
County and generally _______ the community in which he lived.
Who _____ _____ as his knowledge _____ _____ and believed
him to have been a soldier of the Revolutionary War and which
fact he never heard disputed. That about the year 1795 Richmond
McMahon and this _____ moved to North Carolina _______
Buncombe County (now Yancey). That some years after this,
William Jones above mentioned also moved from Virginia to this
County and settled near the deponent where he and his wife whose
maiden name was Dorothy Hampton lived and raised a family at
which place said William Jones died many years ago. That up
to the dte of his death, his character continued good and that no
one in the community has any better character for truth and
probity than he, and it was the general opinion of this community
that he was a faithful soldier in the Revolution and was _____ _____.
Declaimant further avers that his father Richmond McMahon and
his wife moved from this County to what is now _____ Tennessee
when both of them died before any pension laws were passed for
all soldiers of the Revolutionary War. That from information
learned from his father and other old soldiers and the community
in general both here and in Virginia he has do doubt of the truth
and _____ as each fact narrated in the foregoing affidavit. Deponent
further states that he has no interest in the _____ _____ _____ of
this case but simply testifies from a sense of duty.

I Joseph B. Ray of Yancey County and state aforesaid, being sick and
weak of body but of sound and disposing mind, memory and understanding,
considering the certainty of death, the uncertainty of the time therof,
to the end that I may be better prepared to leave this world when it
shall please my God to call me hence, have now determined to direct what
disposition shall be made of my property, both real and personal, after
my decease. And after materially considering the circumstances and
condition of all those among whom as my heirs at law, as the objects of
my gratitude and affection in my judgement my estate shall be divided. I
do make, publish and declare this to be my last will and testament,
hereby revoking and making null and void all former last wills and
testaments, and writings in the nature of last wills and testaments, by
me hithertofore made.
And my will is first that my body shall be decently buried without
ostentation or unnecessary expenses, and that my funeral charges and just
debts shall be paid by my executors here unto named, and as to the
residue of my estate and property with which God has blessed me, and
shall not be required for the payments of my debts, funeral charges, in
and above the execution of this my will and the administration of my
estate, I give and devise and dispose thereof as follows, TO WIT:
ITEM I
I give and devise to my beloved wife Sarah Ray all my household
furniture and all my stock, to hold the same to her and her heirs,
executors and administrators to her and their use behoof of me.
ITEM II
I give and bequeath to my son Leroy Ray all the tract of land where I
now live, including all the land below the cross fence, which cross fence
winds pretty much east and west through the old fields between here where
I now live and where B.J. Moss now lives, running directly from the east
end of said fence to the branch and east corner to David McCaules line or
the old George Wilson line, and from there west and of the aforesaid
cross line, a west course to Young Allen's line, so to run on the north
side of the improved or fenced ground where Amos Boone and Mexico Boon,
his the said Boon's wife now live, all the land below the abouve mention
lines and cross fence of mine. I will to said Leroy Ray as his own
right and property to have and to hold to his own proper use and behoof
to his executors and administrators forever.
ITEM III
I give and bequeath to my son, Amos L. Ray all the balance of my land
lying on said branch above said cross fence heretofore described, running
an east and west course, which line I will to be a
......................O.M. McCaules line to Young Allens line between the
lilnes where Elizabeth Ray now lives and where William Franklin now
lives, and where Amos Boon now lilves.
ITEM IV
I give and bequeath to the afore said A.L. Ray also another tract on
Crabtree, joining the lands of John Griffith to have and to hold as his
own right and property forever, all except a part of the place where
Locky Ray now lives, including the field and cleared ground and any
ground, without paying rent any of their life time, if they choose to
live on the same. Also, Jane Franklin is to live if she chooses on the
land where she now lives, during her life time free of paying rent. Also
Mexico Ray is to live where she now lives, if she so chooses to do, and
pay no rent during her life time. And Locky Ray is to live as long as
she chooses to live where Elizabeth Ray now lives and the afore said A.
L. Ray is not to require them or any of them to pay rent.
ITEM V
I give and bequeath to A.L. Ray and Leroy Ray a tract of land where Enos
Boon now lives, and my town lot in Burnesville, to have and to hold as
their own property right, to their own proper use and behoof of them the
afore said A.L. Ray and Leroy Ray to their heirs forever, and I do
nominate and appoint my son Amos L. Ray to be the sole executor of this
my last will and testament, and I will that A.L. Ray and Leroy Ray take
care of and provide for their mother during her life time.
I also will that A.L. Ray and Leroy Ray pay to my son William Ray
seventy-five dollars each, and that they pay within two years of my
decease. And I also will that they pay Thomas Holloway, son of Sighley
Holloway, fifty dollors, to be paid in two years after my death, which
said Thomas Holloway is equally to divide among his brothers and sisters,
and also that they pay in like manner Leander Thomas five dollars when
called for by them in Yancey County two years after my death.
Given under my hand and seal this first day of January, in the year of
our Lord, 1857. Interline and read before signed or attested.

Also twelve dollars and 45 cents in the possession of Leroy Ray
which I let said Leroy keep in his hands and credit, the same on a note
he holds on J. B.. Ray deceased. A.l. Ray, Executor of J.b.. Ray
deceased, also one deed from Thomas Wilson to J.b.. Ray for three hundred
acres of land lying on the big branch waters of Caney River, including
the place where J. B.. Moss now lives; and there is also a bond in the
hands of Leroy Ray for about 100 acres of land joining the other tract,
including where the said Leroy now lives, exceeded by James R. Law to the
afore said J.b.. Ray. Also one other deed from John B. Blount for one
hundred acres joining the above 100 acre tract on the east side, also a
bond on John G. Blount for two twenty-five acre tracts where William
Franklin now lives, the Widow Turner land; also a copy of a bond executed
to Maximillion Harris by John G. Blount for fifty acres on Crabtree; also
the land where Enos Boon formally lived joining Gardner and others, and
one lower tract in Burnsville; also one mare and one cow and some little
household furniture in possession of Mother.
